XCleanPro – Terms of Service

These Terms of Service (“Terms”) are a legal agreement between the customer (“Client,” “you”) and XCleanPro (“XCleanPro,” “we,” “us,” “our”) for residential and commercial cleaning services. By booking, confirming, paying for, or receiving service, you agree to these Terms.

XCleanPro strives to honor every appointment. However, delays or changes may occur due to events beyond reasonable control (e.g., severe weather, accidents, road closures, illness). We will notify you as soon as possible and reschedule at the earliest availability.

1) Payment Policy

1.1 Accepted Methods
Cash, check, bank transfer, Zelle, and card payments via PayPal (no PayPal account required).

Note: PayPal payments include a 3.5% processing fee charged by the payment provider. Quotes do not include this fee; it appears on PayPal invoices.

1.2 Due Dates

  • New & Recurring clients: Invoices are due no later than 24 hours before service. If unpaid, your appointment may be automatically canceled.

  • If payment is permitted on the day of service and it is not received that day, a 3.5% late fee per day may apply until paid.

1.3 Collections
Invoices 5+ days past due may be referred to Collections. You agree to pay reasonable costs of collection, including agency fees, court costs, and attorneys’ fees.

1.4 Price Adjustments
Quotes are based on information you provide and typical service conditions. If the actual condition/scope differs (excess soil, extra rooms, heavy build-up, post-event, etc.), we may adjust time and price with your approval before proceeding.

2) Cancellations, Reschedules & Lockouts

2.1 Your Changes
Cancel or reschedule ≥ 48 hours before the appointment at no charge. Less than 48 hours notice or no access upon arrival may be billed as follows:

  • Within 48–24 hours: up to 50% of the scheduled service.

  • Within 24 hours / lockout / refusal on arrival: 100% of the scheduled service.

2.2 Our Changes
If XCleanPro cancels, any prepaid amounts for that visit are refunded within 2 business days or applied to the rescheduled visit—your choice.

2.3 How to Request Changes
All scheduling changes must be made through our website: xcleanpro.com/contact. Cleaners cannot modify schedules.

3) Access, Safety & Work Conditions

3.1 Presence at Home
You do not need to be home. If you are home, please allow cleaners to work without interruption.

3.2 Keys & Codes
Provide accurate entry instructions, lockbox/garage codes, or a key if you won’t be present. We will use access information solely to perform your service and safeguard it appropriately.

3.3 Pets
For everyone’s safety, please secure pets in a kennel, a room, or the yard. Our cleaners are not responsible for handling pets. You are liable for damage or injury caused by your pet to personnel or equipment.

3.4 Safe Workspace
We may decline or stop work when conditions are unsafe, unlawful, or unsanitary (e.g., biohazards, pest infestations, mold, exposed wiring, aggressive behavior, harassment). This may be treated as a same-day cancellation.

3.5 Harassment-Free Environment
We maintain a workplace free of verbal, physical, or sexual harassment. Any incident may lead to immediate termination of service and possible legal action.

4) Service Scope & Time

4.1 Hourly Structure
Rates are per cleaner, per hour. If multiple cleaners attend, total time is divided among them.

Example: 4 labor-hours = 2 cleaners on site for ~2 hours.

4.2 Priority-Based Cleaning
Service is time-boxed. Our team follows your priority list to focus on what matters most within the contracted time. If more time is needed, we’ll request approval before continuing.

4.3 Realistic Results
Deep build-up, hard water stains, calcification, rust, grout discoloration, and scratched glass may be partially improved but not fully restored. Choosing to focus extra time in one area may reduce time available in others.

4.4 Add-ons & Exclusions

  • Add-ons (e.g., interior fridge/oven, windows, carpets) must be requested in advance.

  • We do not move heavy furniture/appliances, clean high-risk exterior windows, handle hazardous waste, or perform tasks requiring trade licenses (plumbing, electrical, construction).

4.5 Parking & HOA
Client provides legal parking and any required building/HOA access. Fees or delays caused by building restrictions may be billed.

5) Quality Assurance & Claims

5.1 Satisfaction Guarantee
If you are not satisfied, notify us within 24 hours of service completion. We will return to re-clean the reported areas at no additional cost.

5.2 How to File a Claim
Submit via xcleanpro.com/contact with your name, service date, address, and photos of the concern. We review cleaner notes, your order details, and your claim to determine next steps.

Re-cleans target only the areas listed in the claim.

6) Damage, Breakage & Liability

6.1 Reporting
Accidents are rare but can happen. Report suspected damage within 24 hours of service with photos and a description. We will investigate promptly.

6.2 Pre-Existing Conditions
We are not responsible for wear, pre-existing damage, faulty fixtures, unstable shelves, picture frames, blinds, or items not properly secured by the property owner.

6.3 Replacement/Repair
At our discretion, we may repair, replace, or reimburse up to the reasonable market value of the item (depreciated). Maximum aggregate liability for any service is limited to the amount paid for that service.

7) Conduct & Non-Solicitation

7.1 Direct Hiring
For 12 months after your last service, you agree not to directly hire or solicit any XCleanPro cleaner for services outside XCleanPro. If you do, you agree to pay a placement fee of $750 to cover recruiting, background, and training costs.

7.2 Tips
Tips are optional and appreciated. You may add a tip to your invoice or hand it directly to the cleaner.

8) Photos, Reviews & Marketing

With your consent (e.g., via checkbox or email), we may take before/after photos of areas cleaned to document results—no personal data is shown. You grant us permission to use your text reviews in marketing. You may withdraw consent at any time.

9) Force Majeure

We are not liable for delays or failures caused by events beyond reasonable control, including extreme weather, acts of God, strikes, labor shortages, utility outages, or governmental restrictions.

10) Disclaimers & Limitation of Liability

Services are provided “as is” and “as available.” Except as expressly stated herein, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
To the maximum extent permitted by law, XCleanPro/M&PSSSJ LLC and their officers, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages. Total liability shall not exceed the amount paid for the service giving rise to the claim.

11) Changes, Suspension & Termination

We may modify these Terms or suspend/terminate service to any Client who breaches these Terms, creates unsafe conditions, or engages in abusive conduct. Material changes will be posted on our site with an updated “Last updated” date.

12) Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws. You agree to the exclusive jurisdiction and venue of the state and federal courts in Collin County, Texas.
